What if Nintendo notices about SMWC?

I thought this could be an interesting tread, how would nintendo react if they'd notice there is a website full of people who hack one of they're most popular games.

In my opinion, I don't think they would like it, maybe they would try to take the site down..I don't think they would make it anyway since there is no illegal stull like ROMs here.

What's your opinion?
Mixed. One side, they'll be so damn proud oen of the most popular games has various different facelifts. On the other hand, they may not like that.

Who knows, really... though, if this site shuts down for no unexplained reason, I'll know that I can freely blame Nintendo for it.

I believe that if they had found the site, they would register undercover watching the top hackers. Then, when it comes time to make a new game, they contact those hackers, and invite them to visit a Nintendo office... Once they are at the office, Nintendo would lock them in the basement, and create a new game based of their hack. Seeing as how this hasn't happened yet, I assume they don't I know. Wait.....what if one of the staff members works for Nintendo? [/crazyness]

Wait....what? I think that they would just look around, understad that we are just honoring their game, and not do anything. It's not like we are making money off these.

If Nintendo found this place? They would most likely take all the custom make graphics and sprites and use them for their next Mario game. In all seriousness, I don't think they would really do anything or for that matter care for as to what is going on. I mean since the dawn of the first emulator and rom there have been countless sites made in regards to them. Meaning that this would only be one site in the jar of millions. To think of it this way they would have bigger fish to fry in terms of sites to shut down, or to sue.

To sum it up, nothing at all as there is nothing here that is considered illegal, with exception of the copyrighting of the graphics, but after that nothing.

Nintendo probably knows and doesn't care. They are probably proud, because we can use their original knowledge and make our own hacks.
They could make a Nintendo game from all the hacks we made called "SMWC Mega Collection"

Honestly, they would most likely just not care. This game is like, 20 years old? They aren't making enough money off of SMW to try and sue.

Well for one, the site doesn't host any ROMS, which is the major law that people worry about when they break it. However, since it only hosts IPS patches as hacks, there is nothing illegal being hosted, as far as to hacks.
I guess Nintendo could care because obviously anybody who submits a hack here has for sure used a ROM, except for reuploaders. But they can't see the IP addresses to send a desist order. Since no ROMs are hosted here or are linked to they can't prove anything besides what I said in the first sentence. (It's possible to just base your hack off an empty IPS but who the fuck does that.)
Not only would they not do anything, they could not do anything. They have no legal precedence on which to base any accusations. Luckily, most of the people here aren't stupid enough to actually try to get this site in trouble by submitting ROMs (Most, not all, theres a few morons I suppose, but that's inevitable.)

Nintendo being proud is an eventuality I hadn't considered. All in all, it seems the most likely outcome based on the way we deal with actual illegality on the site.
I think it might come down to who at Nintendo sees the site. The corporate mucky-mucks who care only about money would probably do as some have said and search for any copyright-infringing activity going on here, but seeing none, I think they would eventually leave it alone. This ain't no threat to Nintendo.

On the other hand, if a lesser employee who actually is involved with the creative process of creating games saw what some of our users are doing using the rather limited resources of SNES hardware, they would be ecstatic.

At the end of the day, it's a non issue.

Meh, I don't think they would go sue us. Besides, Roms ARE illegal here. Also, they aren't making "classics" like capcoms megaman 9 & 10.

Now on the other side, if we were actually making money out of our hacks, they would sue us.

Right. And they would have a right to.

It's kind of the same thing with underground hip-hop mixtapes. Those are 99% of the time distributed for free, so the producer(s) often go crazy including all kinds of samples from copyrighted songs. If those samples had been included on a commercial album, though, neither the artist, the producer, nor the record label would make any money, because of having to pay licensing fees for all those copyrighted works.
But since, in the case of the free mixtape, no money is changing hands, the publishers of those songs have no real interest in pursuing legal action.

Bottom line: What we're doing here is pretty much underground, and nobody's making any money from it, so I think it's safe to say that we have nothing to worry about.

If they knew, they'd know by now. Miyamoto himself made quite a number of statements in interviews about emulators before, in fact.


Also, they would submit their own rom hack, "Super Mario World" only to find it rejected.
