France's anti-piracy law comes into effect

The law was passed after a long struggle in parliament, and in the teeth of bitter opposition from groups opposed to internet restrictions.

Illegal downloaders will be sent a warning e-mail, then a letter if they continue, and finally must appear before a judge if they offend again.

The judge can impose a fine, or suspend their access to the internet.

The Creation and Internet Bill set up a new state agency - the Higher Authority for the Distribution of Works and the Protection of Copyright on the Internet (Hadopi).

The law was backed by President Nicolas Sarkozy and the entertainment industry.

Many opponents

Its supporters say it is a model for other countries around the world that want to protect their creative industries and make clear to ordinary web-users that not everything is for free.

Michel Thiolliere, a French senator and member of the Hadopi, says that if the law is explained properly, then people understand it.

"The internet is a fabulous world, but it needs rules, if you want to get cinema, music or video games in the future.

"What we think is that after the first message... about two-thirds of the people (will) stop their illegal usages of the internet.

"After the second message more than 95% will finish with that bad usage."

The law has many opponents, who say either that it is too draconian, or that it has already been overtaken by technology and that serious downloaders will simply sidestep it.

But for supporters, it is a long-overdue necessity.

For them, it is a way of reminding law-abiding citizens who have been tempted by an abundance of apparently free material available on the web, that it does come at a price.

Ooh, harsh. Glad I don't live in France. Makes me wonder what will happen to French ROM hackers, though I don't see how they plan on catching people.

Well France is known to be one of the most pirate-infested countries (no offense to the country, it's a nice place and all). They had it coming to them. Besides, rom hackers don't have much to worry about, since they're probably much more after music pirates (nintendo hardly cares if you pirate SMW, since it's not for sale right now anyway. Popular music however, should be payed for).

The first thing that comes to mind when I read this is how they'd catch them. My guess is that they have a blacklist of websites that has illegal software and such and whenever they detect a user connecting to the website and downloading the material off it, they send the email to them. Or maybe they use IPs to track it, in which case we can use proxys. Either way, I hope this doesn't start happening in other countries. It'd be a shame if I have to ... buy everything.

The only persons who'll be in trouble are generic Internet n00bs that download illegal music and that's all. Other knows how to use Proxys ect.
There's way many people that already protest since HADOPI's creation : Debates, email spam or threats to the creators and those who voted, parodies, Sprite Comics ...
I guess that the creators of the law don't even know what a ROM is, nor SMW hacking.

tl;dr : Experienced Internet users know what to do, only n00bs will be 'caught' by our awesome (</ sarcasm>) government. =D

Oh well, I guess, just like Lemonade already mentioned, there are still plenty of ways to get around this.
Technology evolves much faster than those darn slow governments. ;)

The problem with this law is they're making it so pretty much any download can get you in trouble and they're not consenting copyright holders.
