Layer 3 translucent Issues

First, status bar will always cut off layer 3, you can't avoid that (unless you apply something like the minimalist status bar patch).
Second, what are your settings in #lm{MARIO69}?

You must use level mode 0E.

Explaination:
Layer 3 is only transparent to subscreen. That being said, only layer 2 is usually this if it isn't set to be interactive in the first place. Level mode 0E moves layer 1 and sprites to the subscreen to allow that at cost that objects set behind the foreground now goes behind the background too.
A similar case happen on the mist effect which is only properly transparent on said level mode.
